Terms of Use

Effective date: October 17, 2026

These Terms of Use (“Terms”) apply to your use of localfactcheck.com (the “Site”) and to any report, survey, or subscription you buy from us (together with the Site, the “Services”). The Services are provided by Brian O’Kelly, an individual doing business as Local Fact Check (“Local Fact Check,” “we,” “us,” or “our”). By using the Site or buying a report, survey, or subscription, you agree to these Terms, our Refund Policy, and our Privacy Policy, which explains how we handle personal information. If you don’t agree, please don’t use the Services.

1. What Local Fact Check does

Local Fact Check checks what AI tools (such as ChatGPT, Gemini, and Google’s AI answers) say about a local business, including its name, phone number, hours, website, and the competitors those tools name, and reports what it finds. We offer a one-time AI visibility report; an optional full internet survey, a one-time add-on to the report that covers the top 10 things affecting how a business shows up in search, including negative reviews; and two optional monthly subscriptions: the monthly re-check, which repeats the check each month and emails you what changed, and Monitoring Plus, which includes the full internet survey and the other features described at checkout. You decide whether and how to make any changes to your business information.

2. Who can use the Services

The Services are intended for businesses and professionals, but anyone may view the Site. You must be at least 18 years old to submit a form or make a purchase. If you buy on behalf of a business, you confirm that you are authorized to do so. The Site is not directed to anyone under 18, and we do not knowingly collect personal information from anyone under 18.

3. Forms and emails

When you submit a form or place an order, you agree to give accurate information and to submit only information you have the right to share. Please do not send passwords, account logins, health information, payment card numbers, or other sensitive information through the Site’s forms or by email.

We may send a business a free sample email using business contact information that is publicly available. Every marketing or free sample email we send includes an unsubscribe link. You can also opt out at any time by writing to support@localfactcheck.com. Opting out of marketing does not stop messages about an order or subscription, such as your report, monthly updates, billing messages, and replies to your questions. Our Privacy Policy explains how we handle what you send.

4. Ordering a report or survey

Price. The prices of the one-time report, the full internet survey, and our subscriptions are shown on the Site and at checkout before you pay. We sometimes test different prices for any of our products, so the price you see may differ from the price shown to someone else or at another time. The report, and the survey if you add it, are charged when you buy them. The price shown at checkout is the price you pay. We don’t adjust past purchases if a different price is shown to someone else or offered later. Prices are in US dollars. Any applicable sales tax is shown at checkout.

Payment. Payments are processed by Stripe through Stripe Checkout. You enter your card details directly with Stripe, and your payment is also subject to Stripe’s terms. We never receive or store your full card number.

Delivery. We’ll deliver your report by email within the delivery time shown at checkout. If we can’t deliver it within 14 days of purchase, we’ll refund you in full.

Full internet survey. When you order a report, you can add the full internet survey for a one-time price of $20. The survey covers the top 10 things affecting how your business shows up in search, including negative reviews. We’ll deliver your survey by email within 1 business day of your purchase. If we can’t deliver it within 14 days of purchase, we’ll refund the survey in full.

5. Monthly subscriptions (automatic renewal)

We offer two optional monthly subscriptions. You can choose one or the other:

  • Monthly re-check ($19 per month): we repeat the check each month and email you what changed.
  • Monitoring Plus ($29 per month): an alternative to the monthly re-check that includes the full internet survey and the other features described at checkout.

AUTOMATIC RENEWAL. IF YOU ADD THE MONTHLY RE-CHECK, YOUR SUBSCRIPTION RENEWS AUTOMATICALLY EVERY MONTH. WE WILL FIRST CHARGE $19 (PLUS ANY APPLICABLE TAX) TO THE CARD YOU USED AT CHECKOUT 30 DAYS AFTER YOUR PURCHASE, AND THEN EVERY MONTH AFTER THAT UNTIL YOU CANCEL. Your first $19 charge happens 30 days after your purchase, and then every month after that until you cancel.

AUTOMATIC RENEWAL. IF YOU ADD MONITORING PLUS, YOUR SUBSCRIPTION RENEWS AUTOMATICALLY EVERY MONTH. WE WILL FIRST CHARGE $29 (PLUS ANY APPLICABLE TAX) TO THE CARD YOU USED AT CHECKOUT 30 DAYS AFTER YOUR PURCHASE, AND THEN EVERY MONTH AFTER THAT UNTIL YOU CANCEL. Your first $29 charge happens 30 days after your purchase, and then every month after that until you cancel.

Neither subscription has a minimum term, and you can cancel either one at any time. If you cancel before your first monthly charge, you won’t be charged for the subscription.

Switching plans. You can switch between the monthly re-check and Monitoring Plus online, through the link in your Stripe receipt or the Stripe customer portal, or by emailing support@localfactcheck.com. A switch takes effect at your next billing date unless checkout says otherwise. From then on, you’ll be charged the monthly price of the new plan on that same date each month until you cancel.

How to cancel. You can cancel online or by email at any time:

  • online, through the link in your Stripe receipt or the Stripe customer portal; or
  • by emailing support@localfactcheck.com from the email address on your account and asking us to cancel (no special wording is needed).

We’ll confirm your cancellation by email. Cancellation stops all future charges. Your subscription stays active until the end of the month you’ve already paid for or, if you cancel before your first charge, until that date, and the current month is not refunded except as our Refund Policy describes or the law requires. If you are charged after you asked us to cancel, we’ll refund that charge.

Price changes. If we change the monthly price, we’ll email you at least 30 days before the new price applies, and you can cancel before then. If you don’t cancel, the new price applies from your next renewal after the notice period.

Failed payments. If a monthly payment fails, Stripe may retry it. If it still fails, we may pause or end your subscription.

6. Refunds

Refunds are covered by our Refund Policy, which is part of these Terms.

7. Reports and surveys are information, not a guarantee

Reports, surveys, and monthly updates are for information only. We do not promise or guarantee any particular ranking, visibility, mention, recommendation, traffic, leads, sales, or other result in any AI tool, search engine, map, or listing service, whether or not you make the changes we point out. AI tools and search engines are run by other companies, which decide what their tools show and can change it at any time without notice.

Surveys and online reviews. The full internet survey is for information only. It points out issues that may affect how your business shows up, such as negative reviews. We don’t remove, edit, or dispute reviews or other third-party content, and we don’t guarantee any change in your search or AI visibility.

AI-generated content may be wrong. Reports describe and quote answers generated by AI tools, and we also use AI tools to help collect, summarize, and draft report content. AI tools can produce answers that are inaccurate, incomplete, out of date, or inconsistent, and they can give different answers to the same question at different times or to different people. A report reflects what we found when we ran our checks and may not match what you or your customers see later. Please check anything important yourself before relying on it.

Not professional advice. Reports and other content on the Site are general information. They are not legal, financial, marketing, or other professional advice. You are responsible for your decisions about your business, including any changes you make to your website or listings.

8. Third-party names and platforms

The Site and our reports mention third-party products and services (for example, AI tools such as ChatGPT, Gemini, and Google’s AI answers). Those names and marks belong to their owners. Local Fact Check is not affiliated with, endorsed by, or sponsored by any of those companies.

9. Acceptable use

You agree not to:

  1. use the Services in violation of law;

  2. try to gain unauthorized access to the Site, its servers, or its accounts;

  3. interfere with the Site’s operation or security, including by uploading malware or overloading it;

  4. scrape, copy, or harvest content or information from the Site by automated means;

  5. create or contribute to datasets intended for training, fine-tuning, or evaluating AI models;

  6. submit spam, false information, or someone else’s personal information without permission;

  7. order a report or survey about a business you are not authorized to act for, in order to mislead or harm that business; or

  8. impersonate anyone.

Ordinary search-engine indexing that follows our published crawl rules (robots.txt) is allowed. We use security tools to protect the Site and may block access that appears abusive. If you believe you have found a security issue on the Site, please report it to support@localfactcheck.com instead of testing it further.

10. Content and submissions

Our content. The Site’s text, design, logos, and other content, and the format and content of our reports, are owned by Local Fact Check or its licensors and are protected by intellectual-property laws. You may view and print Site pages for your own informational use. That permission does not give you any rights in third-party material on the Site. “Local Fact Check” and its logo are our brand; please don’t use them in a way that suggests we endorse you.

Your report. When you pay for a report, survey, or update, you may use it for your own business purposes, including sharing it with your employees and with people who help you with your business, such as a web designer or marketing provider. You may not resell or republish it as a product or service of your own.

What you send us. You retain ownership of content you submit to us. You grant Local Fact Check a non-exclusive, limited license to use, copy, store, and process that content as reasonably necessary to provide the Services, respond to you, maintain business records, and operate the Site, consistent with our Privacy Policy.

The Site and our reports may link to other websites. We don’t control them and aren’t responsible for their content or practices. Their own terms and privacy policies apply.

12. Disclaimer

EXCEPT AS EXPRESSLY STATED IN THESE TERMS AND OUR REFUND POLICY, THE SERVICES, INCLUDING THE SITE, REPORTS, SURVEYS, AND MONTHLY UPDATES, ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT ALLOWED BY LAW, LOCAL FACT CHECK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT, AND DOES NOT PROMISE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of liability

  1. Excluded damages. TO THE FULLEST EXTENT ALLOWED BY LAW, LOCAL FACT CHECK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA, ARISING FROM OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF LOCAL FACT CHECK WAS TOLD THEY WERE POSSIBLE.

  2. Cap. TO THE FULLEST EXTENT ALLOWED BY LAW, LOCAL FACT CHECK’S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES OR THESE TERMS, COMBINED, WILL NOT EXCEED THE GREATER OF (1) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (2) ONE HUNDRED DOLLARS ($100).

  3. Exceptions. Nothing in these Terms limits liability for fraud, gross negligence, or willful misconduct, or any liability that cannot be limited under applicable law. Some jurisdictions don’t allow some of these limits, so they may not all apply to you.

14. Indemnity (business users only)

If you use the Services on behalf of a business, that business agrees to defend, indemnify, and hold harmless Local Fact Check, its owner, and its personnel against third-party claims arising from your material breach of these Terms or your unlawful use of the Services, and to pay the resulting damages, costs, and reasonable attorneys’ fees finally awarded or agreed in a settlement. Local Fact Check will tell you promptly about any such claim and will reasonably cooperate, at your expense. You may control the defense, but Local Fact Check may take part with its own lawyer at its own cost. You may not settle a claim in a way that admits fault for Local Fact Check or places an obligation on Local Fact Check without Local Fact Check’s written consent. This section does not apply to individuals using the Services for personal purposes.

15. Governing law; jurisdiction and venue

Washington law governs these Terms, without regard to conflict-of-laws rules. Any lawsuit about the Services or these Terms must be brought exclusively in the state courts for Snohomish County, Washington, or, for federal court, in the United States District Court for the Western District of Washington, Seattle, and you and Local Fact Check consent to the personal jurisdiction of those courts. Either party may bring a qualifying claim in small claims court.

16. Changes

We may update these Terms from time to time. We’ll post the new version on this page and change the effective date. Changes become effective when posted unless we state otherwise, and your continued use of the Services after the effective date constitutes acceptance of the revised Terms. If you have an active subscription and a change materially affects it, we’ll email you before the change applies to you, and you can cancel before then. Changes don’t apply to orders placed before they were posted.

17. General

These Terms, our Refund Policy, and our Privacy Policy are the entire agreement between you and Local Fact Check about the Services. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign or transfer your rights or obligations under these Terms without our written consent. Local Fact Check may assign or transfer its rights and obligations under these Terms in connection with a sale, reorganization, merger, or other transfer of its business or assets.
